  Barr Notice Guide for Landlords

The Waynesboro Police Department has created the following document to assist landlords of property located within the City limits of Waynesboro, Virginia should they need to “barr” a guest or invitee of a tenant for conduct on the property where the premises are located that violates the terms and conditions of the rental agreement, a local ordinance, or a state or federal law.

  Please note this guide should only be utilized by a landlord to barr a guest or invitee of a tenant pursuant to Virginia Code 55.1-1246 (Barring guest or invitee of a tenant). In addition, this code section places the responsibility of notice on the landlord and if a violation occurs it is the landlord’s responsibility to petition for a warrant prior to enforcement action from the police.

Trespassing Notice Guide for Citizens

The Waynesboro Police Department has created the following document to assist citizens of Waynesboro, Virginia should they need to trespass a person(s) from personally owned property in the City of Waynesboro.

Please note this guide should not be used by any landlord, to bar a guest or invitee of a tenant. For those instances please see Virginia Code 55.1-1246 (Barring guest or invitee of a tenant).

Trespassing is defined as any person without authority of law goes upon or remains upon the lands, buildings or premises of another, or any portion or area thereof, after having been forbidden to do so, either orally or in writing, by the owner, lessee, custodian, or the agent of any such person, or other person lawfully in charge thereof. (See Virginia Code 18.2-119 for more information).
