[ARCHIVED] Charges Dropped against Home Invasion Arrestee

Update – October 15, 2015

Ty Quane Pertell Gregory, 19 years old of Charlottesville, is in custody. Officers with the Harrisonburg Police Department arrested Gregory in downtown Harrisonburg on October 14, 2015 at approximately 6:30 PM. He was found at an apartment on East Market Street just east of Court Square. The Virginia State Police and Rockingham County Sheriff’s Office also assisted with the apprehension.
He is incarcerated at Middle River Regional Jail without bond.

The charges against Marquell Anthony Diggs in the September 18, 2015 home invasion robbery have been dropped.

The Waynesboro Police Department no longer considers Mr. Diggs as a suspect in the crime. On the day of the incident, officers charged Mr. Diggs with three felonies: Armed Robbery; Use of a Firearm in the commission of a felony; and Possession of a Firearm by a convicted felon. Mr. Diggs surrendered himself around noon at the Police Department on the day of the incident. He was ordered held without bond on the charges at Middle River Regional Jail. He was also held on a probation violation.

The charges originated from witness accounts of his presence at the scene of the crime. Officers later disproved those accounts.

At the request of the Police Department, the Waynesboro Commonwealth’s Attorney was able to secure Mr. Diggs’ release from Middle River Regional Jail on September 23, 2015. The Commonwealth’s Attorney had the charges dropped on September 29, 2015 in Waynesboro General District Court.
